OUR  TERMS & CONDITIONS

We are Inca Trail Expeditions. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us in Cusco, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Inca Trail Expeditions. The term “you” refers to the customer visiting our website, booking a reservation through us or otherwise using our services

These booking conditions only apply to the trip arrangements which you book with us in Peru and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references in these booking conditions to “trip”, “booking”, “contract” or “arrangements” mean such trip arrangements unless otherwise stated. References to “departure” mean the start date of these arrangements.

1.- OUR AGREEMENT WITH YOU

  • Your Responsibilities

Medical considerations: If you have any medical or psychological conditions, it’s very important you let us know well before departure so that we can make extra arrangements if necessary. Trip leaders have the right to disqualify anyone at any time during the trip if they feel the trip member is mentally or physically incapable to continue and/or if a trip member’s continued participation jeopardizes the group’s or his/her own safety. Under these circumstances refunds are not given.

Inca Trail Expeditions is not a medical facility and therefore has no responsibility regarding medical advice, medications or inoculations that you or your doctor deem necessary for your safe participation.

Hospital facilities for serious problems are often unavailable, and evacuation can be prolonged, difficult and expensive. Inca Trail Expeditions  assumes no liability regarding provision of medical care. By signing the Liability Release and Assumption of Risk Agreement, you agree to pay for emergency evacuation and emergency medical care.

  • Your obligations as a trip member

By participating in an Inca Trail Expeditions trip, you assume certain obligations to Inca Trail Expeditions and the other trip members. It is your responsibility to:

    • Understand the conditions implied in the Activity Level rating of your selected trip
    • Select a trip that is appropriate to your interests and abilities
    • Prepare for the trip by familiarizing yourself with the trip itinerary and trip preparation materials sent by Inca Trail Expeditions
    • Bring appropriate gear and clothing as advised by Inca Trail Expeditions
    • Obtain all necessary visas or passports
    • Follow considerate standards of personal hygiene in order to reduce risk of contracting diseases
    • Follow considerate social behavior with other trip participants and respect their habits
    • Act in an appropriate and courteous manner befitting the customs of countries you visit
    • Complete the trip itinerary as scheduled (or as adjusted by your trip leader as necessary)
    • Respect the countries we visit by using environmentally safe products, staying on established routes of travel and not littering.

Inca Trail Expeditions reserves the right to decline to accept or retain any person as a tour participant should such person’s behavior, health or mental condition impede the operation of the trip.

  • Products and Suppliers

We sell a variety of travel related products from different suppliers and service providers (“Suppliers”). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions.

Inca Trail Expeditions is acting as intermediary or a “Booking Agent” for products and services that are not directly supplied by us (e.g., ground transportation, hotel accommodations, meals, tours, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

  • DEPOSIT AND PAYMENTS

1.- Small groups are asked to fill in the attached letter of guaranty in order to confirm and guaranty their reservation. Afterwards the actual payment is made directly in the first Hotel of the Tour for the Travel Packages, If you are doing any other hiking tours like the Inca Trail, Ausangate Trek, Lares Trek, the payment will be done at our travel office in Cusco the day of your arrival. In case of cancelations, modifications or no shows outside of the deadlines, there will be a charge to the credit card detailed in the letter of guaranty.

2.- PAY WITH CREDIT CARD

Instructions to pay online with Visa, MasterCard, American Express, JCB card

We connect with Paypal and Izipay to accept card payments online. All your card information is processed through the SSL protocol with the international card security standard. Your card information will not be stored in our system (merchant) but in MasterCard or Visa with the international security standard.

Once you have received your order via a link, check the Order information. If all the information is correct, read and accept the Terms and Conditions before clicking to pay. You will be redirected to Culqui to pay us online with Visa, MasterCard, American Express and JCB Card.

Note: In some cases, your transaction may not be successful due to:

– Incorrect card information

– There is not enough credit balance (daily or monthly)

– Your card has not been activated for online payment. You must contact the issuing bank to activate the card.

In case you enter the correct card information but did not receive the transaction result from the payment gateway or from us. Please do not try to make any other payment. Contact us to obtain the result of the transaction and the order confirmation (Email: info@incatrailexpeditions.com)

3.- PAYMENT AND DEPOSIT TO BOOK TRAVEL AND VACATION PACKAGES

a – Deposit: A deposit of 30% of the total value is required by credit card at the time of confirmation of your reservation. Once the deposit of your reservation has been made, it is agreed that you have read, understood and accepted all of our Terms and Conditions.

b – Remaining balance: The remaining balance of the tour value (70%) will be paid upon arrival.

  • Regarding groups (more than 9 people), 100% payment has to be made 30 days in advance, otherwise it will be cancelled.
  • In case of groups going to Machu Picchu or Inca Trail 100% payment is necessary 40 days in advance of the reservation. 100 days before in case of a charter.
  • Once a payment for a tour to Machu Picchu or Inca Trail is made and a cancelation or modification occurs, there will be a penalty charge of 100% of the total price.

3.-  All the balance Payments that will be paid at your arrival to Peru in our travel Offices in Lima or Cusco, is possible done with any credit or debit card, plus a fee of 5% as well. Or you can pay in USD dollars cash.

Any deposits from you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.

To make a booking please follow the procedure shown on our website or ask to our chat online. The relevant application form needs to be completed by each person travelling.The completed booking form must then be sent to us together with the payments referred.

Where we have already confirmed the availability of your chosen arrangements and you book within any applicable time limit for doing so, your booking will be treated as firm and a contract between us will come into existence as soon as we receive your completed application form and your deposit. We will then send you a receipt for all payments made and our invoice. Where we have not confirmed availability, your booking will be treated as firm and a contract between us will come into existence when we despatch our invoice to you. Where you book through our website without prior confirmation of availability, any electronic acknowledgement of your booking is not a confirmation of it. Please check your invoice carefully as soon as you receive it. Contact us immediately if any information which appears on the invoice or any other document appears to be incorrect or incomplete.

  • The price quoted for any trip covers the cost of the planning, the organisation and carrying out of the trip, including group equipment, supplies, accommodation, administration and staff, except for the following, for which the you must be responsible: vaccination fees, travel insurance, cost of travel to and from the start / return point of your trip including your international flights, cost of passport and visas, personal equipment and personal expenses while on the trip and any other expenses specifically excluded on the trip description and/or invoice.

We reserve the right to make changes to and correct errors in quoted prices at any time before your trip is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking.

  • Cancellations and Changes

Your contract with us may allow them to cancel or amend bookings. If we are your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.

2.- YOUR AGREEMENT WITH US

  • OUR LEGAL LIMITATIONS – PLEASE READ CAREFULLY

Inca Trail Expeditions may contract with independent contractors to provide transportation, guide services and/or all other related travel services. We assume no responsibility, however caused, for injury, loss or damage to person or property in connection with any service provided by an independent contractor or resulting directly from the following: – acts of God – detention – annoyance – terrorism – thefts – pilferage – force majeure – civil disturbances – government restrictions or regulations – strikes – delays and expenses arising from quarantine – failure of any means of conveyance to arrive or depart as scheduled – discrepancies or change in transit or hotel services over which we have no control.

We reserve the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of trip members. By advancing deposit to Inca Trail Expeditions, the depositor thereby agrees to be bound by the above terms and conditions.

  • Cancellations

The reservation deposit is not refundable.If you decide to cancel your trip, the following fees apply and are due to Inca Trail Expeditions  at the time (prior to departure) we receive written notice of your cancellation. Some trips may have special cancellation or transfer fees; if so, they will be listed on the Itinerary Details or supporting trip documents.

  • Travel insurance

Should you have to cancel your trip because of illness, injury or death to you or an immediate family member, this insurance protects all your deposits and payments for both air and trip costs. We will mail you the necessary forms in your trip packet. Inca Trail Expeditions  recommends that you purchase this insurance at the time of sign-up to be covered for pre-existing conditions (certain restrictions apply). We strongly recommend the purchase of trip insurance.

  • If we cancel a trip

Inca Trail Expeditions reserves the right to cancel all or a portion of a trip for force majeure or any other circumstances beyond our control and, in the event of such cancellation, full or partial refunds, if any, will be at Inca Trail Expeditions sole discretion. We also reserve the right to cancel any trip if sign-up is inadequate to make the trip economically feasible for us to operate, and in this event, we give a full refund of the trip price. However, Inca Trail Expeditions is not responsible for additional expenses incurred by you in preparing for the trip (e.g., non-refundable air tickets, visa fees if applicable, gear or medical expenses).

  • Fewer than required number of participants

Each trip requires a minimum number of participants for departure. If we sign up enough participants to run a trip but unexpected cancellations drop the number of participants below the required minimum, we will run the trip at an additional charge per person.

  • Refunds

Inca Trail Expeditions does not give any refunds for unused hotel rooms, meals, sightseeing trips or trek arrangements. Trip price is quoted as a package; credits are not given for services not used.

  • Your Acceptance of these Terms and Conditions

By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including Parts 1-3 of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

  • If You Change Your Booking

Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Please contact your original booking agent to enquire about changes, for details of how to request changes. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

  • Policies and Penalties for Cancelations or Modifications

Cancellation of bookings must be notified to us by letter or email by the party leader as soon as possible. Your notice of cancellation will only be effective when it is received in writing by us.

* For return of train tickets will need the following documents: passport (via scan), proxy letter to Andean Great Treks, authorizing act on your behalf to the railway company. These documents must be sent within 24 hours of canceled train ticket.

2. For other tours that are not Machu Picchu or Inca Trail

In addition to the cancellation terms and conditions of our Supplier(s), our standard fees will apply as may be outlined on your receipt or booking confirmation. We need to receive from you your original voucher before any applicable refund can be considered. If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

  • If You Have a Complaint

If you have a problem during your holiday, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us, either through the office where you made your arrangements, or through www.incatrailexpeditions.com. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.

  • Travel Documents and Destinations

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.

Prior to booking international travel, we recommend that you review any Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.

  • Passport, Visa and Immigration Requirements

It is your responsibility to fullfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

You are also required to carry a valid International Student I.D, if you are traveling on a special student/youth/ ticket. It is your responsibility to verify this with our travel experts who is assisting you.

  • Travel Insurance

Travel insurance is a vital part of your arrangements. We strongly recommend that you have taken out adequate insurance for the duration of your journey. It is essential that you have adequate and appropriate cover for your trip including any adventurous activities such as trekking at altitude. Note that the majority of our trips do not require the use of climbing ropes and are all supervised. It is important to have adequate insurance which will cover cancellation costs from the date of booking as well as medical expenses (including evacuation and repatriation). If you travel against the advice, the validity of your insurance policy may be affected. Please read your policy details carefully and take them with you on your trip. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

  • Health: Except as disclosed in your medical questionnaire, you are taken to confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the trip, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the trip, taking into account its challenges and purposes. If you are unable to give for this confirmation for any reason or have any medical condition or disability which may affect your trip, you must contact us before you submit your application form so that we can assist you in considering the suitability of the trip for you.

If any information given in the application form or medical questionnaire is shown to be materially incorrect or incomplete, we reserve the right to cancel your booking or terminate your participation in the trip, depending on when we become aware of the true position. In this situation, cancellation charges will apply and we will not be responsible for any costs or expenses incurred as a result.

  • Special requests: Please advise us of any special requests prior to making your booking. Where possible, we will endeavour to meet or arrange for our suppliers to meet any such request. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your own protection, you should obtain confirmation in writing that a special request will be complied (where it is possible to give this) where it is important to you.
  • Travel Advice and Vaccinations

Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

  • Privacy Policy

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us in accordance with the terms of and for the purposes set forth in our privacy policy. You represent that you have read and agree to the terms of our privacy policy, which can be found at our website

3.- RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

All participants must sign the following Release of Liability, Assumption of Risk and Indemnification Agreement. A copy of this form will be included in your confirmation packet.

  1. TRIP AND ASSOCIATED RISKS – I have chosen to participate in the above referenced trip (hereinafter referred to as “the Trip”), which is organized by Inca Trail Expeditions (hereinafter referred to collectively as “Inca Trail Expeditions”). I understand that:

The Trip involves activities that are inherently hazardous, including those described in the separate document for the Trip, “Activity Level and Risks & Hazards,” which has been provided to me and which I am also signing and returning; During the Trip, I may be exposed to dangers and hazards, including equipment failures and negligence by others;

As a consequence of these risks, I may be seriously hurt or disabled or may die from the resulting injuries, and that my property may also be damaged; Hospital facilities, qualified medical care, and emergency medical evacuation may be limited or unavailable during portions of the Trip and, where available, may be expensive; and

Inca Trail Expeditions  assumes no responsibility for providing medical care during the Trip, and I will have to pay for any medical care and/or evacuation that I incur. In consideration of the permission to participate in the Trip, I agree to the terms contained in this document.

  1. ASSUMPTION OF THE RISKS – I hereby freely assume the above mentioned risks and any harm, injury or loss that may occur to me or my property as a result of my participation in the Trip-including any risks caused by the negligence of Inca Trail Expeditions, its employees and officers, its contractors, and other trip participants.
  2. WAIVER AND RELEASE OF LIABILITY I hereby WAIVE AND RELEASE ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS against Inca Trail Expeditions, its employees, officers, directors, vendors and contractors (“Released Parties”), where such LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arise in any way from any injury, death, loss or harm (whether foreseen or unforeseen) that occur to me or to any other person or to any property during the Trip or are in any way related to the Trip. This release includes, but is not limited to, claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Peruvian Law does not permit to be released by agreement. I also agree NOT TO SUE or make a claim against the Released Parties for death, injuries, loss, or harm that occur on the Trip.
  3. INDEMNIFICATION HOLD HARMLESS AND DEFENSE I promise to INDEMNIFY, WARRANT, HOLD HARMLESS AND DEFEND the Released Parties (defined in Section 3) against any and all LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS that arise from my acts or my failure to act (including my own negligence) during or relating to the Trip. In accordance with this promise, I will reimburse the Released Parties for any damages, reasonable settlements and defense costs, including attorney’s fees, that they incur because of any such claims made against them. I agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this Section, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them.
  4. OTHER FORMS & TERMS – I have carefully read Inca Trail Expeditions Reservation Information, Health Form, “Activity Level and RISKS & HAZARDS,” and, if partcipating on a Inca Trail Expeditions trips, I have also carefully read the “About Inca Trail Expeditions trips” document, and have familiarized myself with all of the information provided to me about the Trip and its rating. I agree to all of the conditions in the Reservation Information- including the sections about my responsibilities and about Inca Trail Expeditions legal limitations. I acknowledge that Inca Trail Expeditions has no control over and assumes no responsibility for the actions of any independent contractors providing any services for the Trip.
  5. SEVERABILITY – I agree that the purpose of this agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by Peruvian law. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.
  6. APPLICABLE LAW, FORUM & ATTORNEY’S FEES – This agreement is governed by and shall be construed in accordance with the laws of the country of Peru, without any reference to its choice of law rules. I agree that any dispute arising from this Agreement or in any way associated with the Trip shall be brought in the Superior Court of Peruvian County, Cusco, or in the Peruvian District Court for the Distric of Cusco, and I agree to the jurisdiction and venue of those courts for any such dispute. In any litigation in which the validity or enforceability of this agreement is contested, I agree that the prevailing party will pay all attorney’s fees and costs of the parties seeking to uphold the agreement.

I have fully informed myself of the contents of this agreement by reading it before signing it. No oral representations, statements or other inducements to sign this release have been made apart from what is contained in this document.

If participant is a minor, signature of parent or guardian is also required: In consideration of my minor child’s being permitted to participate in the Trip, I accept and agree to the full contents of this agreement. I understand that I am responsible for and I accept the responsibility for the supervision throughout the duration of the Trip of any minor traveling in my care. I also agree to RELEASE, HOLD HARMLESS, INDEMNIFY AND DEFEND the Released Parties (defined in Section 3) from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to my minor child during the Trip or in any way related to the Trip. This includes any claim of the minor and any claim arising from the negligence of the Released Parties. I understand that nothing in this agreement is intended to release claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Peruvian law does not permit to be excluded by agreement.

  • Our Liability to you

We promise to make sure that the trip arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care.

Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers).

We will not be responsible for any injury, illness, death, loss (including loss of possessions and loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

Your act(s) and/or omission(s); or

The act(s) and/or omission(s) of a third party not connected with the provision of your trip and which were unforeseeable or unavoidable; or ‘force majeure’.

We cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services which any supplier (including any of the regional Adventure Alternative companies) agrees to provide or arrange for you where we have not agreed to provide or arrange these services as part of our contract. Such additional services will include any activities which do not form part of your contracted trip arrangements which a supplier agrees to provide or arrange for you while you are away.

In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.

Conditions of suppliers: Suppliers, including transport operators, provide their services in accordance with their own terms and conditions. These terms may limit or exclude their liability to you in the event of death, personal injury, delay or loss / damage of personal possessions.

4.- ADDITIONAL TERMS

Warranties, Disclaimers and Limitation of Liability

For the avoidance of doubt, references herein to “us” “we” and “our” shall also refer to our affiliates. the information, software, products, and services provided by us or our suppliers or published on our website may include inaccuracies or errors, including pricing errors. we do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to such information that appears on our website. we expressly reserve the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. in such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.
